Dart Den.com (also referred hereafter as "Dart Den" or "DD") is a private internet Dart Frog Hobby Community, viewable by the public. Welcome to DartDen.com, a friendly, diverse online community dedicated to the Poison Dart Frog, their care, and the Vivariums in which they live. Please feel free to look around, create a free account, and get involved as much as you would like. If you are new to the hobby, congratulations are in order! Dart Frogs are one of the most rewarding and beautiful species of exotic animals that can be easily and safely maintained in one's home. At Dart Den, you will learn how to care for your Dart Frog and much more.
Dart Den was created to promote a very unique, rewarding and fast growing hobby, as well as to consolidate and archive as much useful information as possible. As with any hobby, there are many tips and little known techniques that beg to be brought to light and there is always room for improvement in every aspect of care and husbandry. This is where the community comes into play and how the valuable discussions held on this site can benefit us all for years to come. We welcome everyone - from Beginner, to the most advanced Hobbyist with years of experience.

Membership allows users to place messages, photographs, images, text and other communications on DD's servers and make use of DD's chat and posting systems.
This User Agreement Contract describes the terms and conditions on which East Coast Dart Frogs, owner of Dart Den.com offers you, if you wish to be a participant in Dart Den forums, gallery or chat features.
By agreeing to this User Agreement Contract, you warrant that you will not post any messages, text, photographs or imagery that is obscene, vulgar, hateful, threatening, or otherwise in violation of any laws.
Our forums are powered by phpBB (hereinafter "they", "them", "their", "phpBB software", "www.phpbb.com", "phpBB Group", "phpBB Teams") which is a bulletin board solution released under the "General Public License" (hereinafter "GPL") and can be downloaded from www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct. The Owner(s) of Dart Den reserve the right to remove, edit, move or close any thread, post, photograph or image for at any time and for any reason.
All messages, postings, images, text or chat, express the views of the author alone, and neither the Owners, Administrator nor Moderators of Dart Den, shall be held responsible for the content of any message.
Please read the following Term and Conditions carefully. By participating in our Website / Forum as a member, you will be deemed to have agreed to be bound by said Terms and Conditions of this entire User Agreement and Contract, and to faithfully comply with same at all times.

1. Registration Requirements
All information required upon registration for each member / user on Dart Den must be accurate and complete. You must update and verify all such information as needed in order to ensure that the information continues to remain accurate and complete.
To become a member of Dart Den, each prospective member must request an account through the forum's registration system, accessed at REGISTER. DD will process the submitter's membership application and, proving that the information is complete and all requirements for registration are satisfied, will forward an invitation to activate the account requested. This invitation may be revoked at any time for any reason listed below, above, or for any reason, whether stated or unstated, by DD's Owner(s).
Submission of the registration form represents the prospective members agreement to the terms of this User Agreement Contract and any subsequent changes, at the point those changes are made and notice is posted within the Community Message forum, available at Community Messages
The individual must be a person, above the age of 17 with the capacity to consent to this User Agreement.
1. Individuals between 14 and 17 years of age may be members of DD under the following conditions. As per the TITLE XVII of the CHILDREN'S INTERNET PROTECTION Act, if the individual is under the age of 18, the parents/guardians of the individual must contact DD's owner before registration. DD will complete the necessary documentation and then complete the registration for this minor individual.
2. Concealing ones age to avoid the above requirement is prohibited.
The individual does not already have an existing account with DD and/or has not received an invitation to activate any account in the past by DD.
The individual has not received a Termination of Account Notice or has had an account terminated in the past for any reason.
The individual has not received a Temporary Ban Notice or has had an account temporarily banned in the past for any reason.
2. Use of Member ID and Password
While you are using Dart Den, it is assumed that all activities made using your Member ID and password are authorized by you - the registrant and owner of that account.
3. Posting of Messages, Photographs and Images
Each DD member acknowledges that all posts made to these forums express the views and opinions of the author and not the Owner(s), Administrators, Moderators or Webmaster (except for posts by these people) and hence will not be held liable for any resulting harm.
DD requires each member to maintain a respectful, fair, friendly, and civil approach to every discussion, posting, chat, image, advertisement, etc.
Each DD member is strictly forbidden from posting, writing, displaying, discussing or causing to be posted, written, displayed, or discussed any abusive, obscene, vulgar, hateful, libelous, threatening, or sexually-oriented material or further, any other material that may violate any applicable law.
Members having concerns about users, persons and/or businesses should contact a board moderator or site administrator with an explanation of the situation.
Each registrant is allowed only one active DD account. No duplicate accounts or posting under different screen-names is permitted.
Posting for another member or non-member, or posing as, or using someone else's account to post is prohibited.
DD will not allow excessive use of its system, including excessive posting, placement of large files on DD.s servers or any other server utilized by DD, including excessive messaging, spamming, flooding, denial of service attacks, etc.
All information placed at any time on DD's servers or any other server utilized by DD is property of DD, and may be utilized, searched, viewed, edited, modified, displayed, deleted, etc. in any fashion.
Members may only access information intentionally provided by DD and may not use cracks, coding flaws, or other tools to mine or gain unauthorized access to protected information.
DD will not release, sell, or trade any information submitted through the registration system, except selected usernames, to any third party, unless required to do so by law or for transfer to a person or organization during a full or partial acquisition.
The IP address and further computer identification, routing, locality, and service provider information of each member is recorded and stored to aid in enforcing this User Agreement Contract.
Each member must agree to DD's use of cookies to store information on their computer.
The topic and text of any post should conform and be on-Topic and relevant to the description of the respective forum where it is posted. Moderators will, may, and can move, edit, delete, or otherwise modify irrelevant posts. Excessive posting of irrelevant posts will lead to referral to the below penalties.
Members should not hijack or change the topic of a parent post. Excessive hijacking of posts will lead to referral to the below penalties.
Forums, topics, posts, images, and any other data may be modified in any fashion by DD moderators, administrators, and owner(s).
Avatars larger than 80px x 80px are not permitted anyone using an avatar larger will be asked to remove or modify it. No Avatar will have Flash or moving imagery.
Signatures - pictures, animated gifs, enlarged text, advertisements, and for sale, trade or wanted item advertisements are not permitted to be included in any signature line(s).
Members are free to post a gallery of images in the DD Gallery, so long as those pictures do not violate any other portion of this User Agreement Contract and the member's gallery's size does not exceed the allocated disk space.
Pictures posted to the gallery should be germane to the mission of this forum – Dart Frogs and related topics. Pictures may be removed at the discretion of the site administration for any reason, at any time.
4. User Conduct
You agree not to provide any Messages, Avatars, Titles, Signatures to the Dart Den forums that:
(a) infringes any third-party intellectual property or publicity/privacy rights, (b) is knowingly false, and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, threatening, invasive of a person's privacy, or otherwise violation of any law or regulation, (c) contains any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, and (d) promotes piracy.
As each forum is specifically tailored to address certain topics, you are responsible for initiating new threads in the correct forum. You should stay on-topic at all times. The appropriate content for each forum is described in detail on the Dart Den forums homepage.
You agree not to post the same message in multiple forums without permission from the Dart Den Administrator. All such requests for permission should be directed through the Administrative forum.
"Impersonation," or assuming the character of another member by copying his username and manner of writing, is not allowed.
"Multiple User Names," or assuming the character of more than one member by using more than one username and manner of writing, is not allowed.
"Flaming or lashing out at other participants or displaying repeated dissatisfaction of Dart Den Administration and corrective actions, is not allowed.
"Spamming," or sending unsolicited electronic junk mail or junk newsgroup postings, in any form, is not allowed.
"Trolling," or posting insulting or deliberately divisive threads/replies for the purpose of (1) harvesting retaliatory insults and flames, or (2) throwing off the balance of the forum, is not allowed.
You agree not to disrupt the normal flow of dialogue or "flood," cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges.
You agree not to use the Dart Den forums to either advertise or promote commercial endeavors, which includes direct posts, as well as, active links to other sites on the Internet, without permission from the Dart Den Administrator. All such requests for permission should be directed through the Administrative forum. You may, however, include URLs or active links to commercial sites, reasonable in number, only for the sole purpose of expanding on comments or providing additional information as part of regular forum interactions.
You agree that you will not incorporate any word in your name, Message ID or custom user title or Avatar, that is defamatory, obscene or profane, or which violates any trademark, service mark, or other proprietary/intellectual property rights of any third party, including, without limitation, that of Dart Den.
Harassment of DD administrators, moderators, owner(s), or other members is strictly forbidden. In those cases where members have questions about moderation of a particular topic, they should take up their concerns privately with the appropriate moderator and/or Dart Den administrator/owner. Public posts questioning said action(s) are restricted.
5. Chat use
The DD chat room will not be Moderated or supervised. As always, each member's use of the chat room acknowledges that statements presented in the DD chat room forums express the views and opinions of the author and not the owner(s), administrators, moderators or webmaster and hence will not be held liable for any resulting harm.
6. Classified Advertisements, Vendors, Sellers and Trading
Each DD member must acknowledge that all items placed within the Classifieds and Trading Post forums are not attributable to DD, its moderators, administrators, or owners. DD does not offer any warrantee or guarantee on listed items. Anyone utilizing the DD servers to sell, offer, accept, trade, or purchase any item or service agrees to hold DD, its moderators, administrators, and owners harmless should any harm result from any transaction. DD is not involved in the actual transaction between buyers and sellers. As a result, DD has no control over the quality, safety or legality of the items advertised the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. DD cannot ensure that a buyer or seller will actually complete a transaction.
Classified items should be placed in the related section. We do not permit ads for Venomous or HOT animals.
DD may remove any item from the Classifieds and/or Trading Post forums at any time for any reason.
Classifieds posted as standalone threads or posted in an unrelated thread in this section will be removed.
Replies to ads are only allowed for questions and answers concerning the products in the ad, and requests for additional information. All other comments will be removed
Sponsor Agreement Guidelines
All sponsor, employees, agents, and contractors of said sponsor must comply with the User Agreement Contract as members of the forum. All sponsors, employees, agents, and contractors of said sponsor must comply with any federal and state law regarding the advertisement, sale, and distribution of animals, plants, products, and all other relevant subjects. Parties in violation of the User Agreement Contract will have their banners and associated user accounts immediately removed from Dart Den. Sponsors will not represent themselves as representatives, contractors, or agents of Dart Den. Sponsors agree to indemnify Dart Den.com for costs in any legal action relating to advertisement disputes. Sponsors agree to indemnify Dart Den.com for costs and damages in any third party legal action. Sponsors may remove their banner from Dart Den by request, but therein forfeit any prorated refund. By submitting payment, the sponsor represents that he or she has been authorized to execute this agreement on behalf of the named sponsor. The sponsor agrees to the terms of this User Agreement Contract. 1000f the sponsorship fees are due and payable by PayPal or Credit Card with receipt of the signed contract and must be paid in full prior to listing of a banner. All fees paid are non-refundable.
*Note- Dart Den.com reserves the right to refuse sponsorship to any party if Dart Den deems there is a conflict of interest based on this sites content or for any other reason.
7. Seller –Buyer – Trader Feedback and Transaction Ratings
All transaction feedback, Ratings and related conversations are only permitted in the "Seller – Buyer -Trader Feedback and Transaction Ratings" forum (also referred to as the "Feedback Forum", for short), which requires Dart Den site user membership and agreement to all site rules and regulations. Seller–Buyer–Trader Feedback and Ratings is not permitted in threads, posts, ads, signatures or anywhere else.
Here are Examples of what are considered permitted postings that can be used in any other sections of Dart Den, at any time:
o "Here is a picture of my new pumilio, thanks to _______."
o "Please contact me via PM or email with your experiences with ______."
o "Where did you get that cool Bromeliad?"
The Feedback system is currently operating on a trial basis and may be removed at any time for any reason.
As a DD member, you agree to always use caution, fairness and good judgment when leaving Feedback for another Member, Vendor or Sponsor.
Dart Den's Feedback forum is designed to encourage open and honest trading. However, to insure that Feedback is used for the proper purpose and not abused, DD has some basic rules that must be followed.
Members agree to never attempt to undermine the Feedback system by using practices such as:
Feedback Extortion - Threatening to leave negative or neutral feedback for another member unless the other member provides goods or services not included in the original listing
Feedback Manipulation - Feedback left or received where the Feedback's primary value is to artificially enhance a member's reputation
Feedback in Seller Terms and Conditions - Sellers are not permitted to include in their listings or terms of sale any conditions that limit or restrict the buyer from leaving Feedback.
Feedback Abuse – Buyers or Sellers are not permitted to include links, profanity or other inappropriate or unrelated content within Feedback comments.
Feedback comments containing any of the following are not permitted:
*Links or scripts
*Negative statements left for a buyer that conflict with the positive rating
*Personally identifying information about another member, including but not limited to, real names, address, phone number, or email address
*Political, religious, or social commentary rather than a genuine comment about the transaction
*The comment, reply, or follow-up references a completely separate transaction or unrelated experience
*Profane, vulgar, obscene, racist language or any verbiage that would violate any laws.
*Inflammatory language, such as fraud, liar, cheater, scam artist, con man.
Any Violation of Dart Den policies may result in an infraction being issued, account suspension or account termination, at any time.
8. Content Filtering
Dart Den reserves the right to edit, delete, or prune any and all Messages which, in its sole opinion, violates any of the terms and conditions of this Agreement, or is viewed in our judgment as inappropriate at the time of submittal or for any other reason, at anytime thereafter.
Dart Den may elect, at its sole discretion, to monitor some, all, or no areas of Dart Den for adherence to these terms and conditions or Dart Den policies and guidelines.
Dart Den does not endorse or recommend any of the opinions or ideas contributed by its users.
Dart Den is not responsible for any Messages, Text or Imagery expressed anywhere in Dart Den.com forums. Dart Den does not attempt to control or validate any comments or a recommendation provided by the participants and is not responsible for any inaccuracies in the Messages. Therefore, you alone bear the risk associated with the accuracy, completeness or usefulness of any Messages, imagery posted or sent to others.
Information contained in the Dart Den forums, including but not limited to those relating to law or medicine or other fields, is not intended to substitute for the advice or opinion of your own lawyer or physician or professional adviser. You agree not to rely solely on any of the advice or opinion expressed anywhere in Dart Den. Under no circumstances, including but not limited to negligence, shall Dart Den be liable for any reliance on any such information, nor shall Dart Den be liable for any direct, incidental, special, consequential, indirect or punitive damages that result from the use of, or inability to use, the information in Dart Den.
Dart Den specifically does not endorse or recommend any posts which encourage breeding Hybrid morph Dart Frogs, Selectively breeding Dart Frogs, Mixed or unknown locale Dart Frogs, Invasive species (plant or animal) and prohibits the use or said use of any illegal activates.
Users agree not to post anything which incorporates politics or religion in any form, anywhere on Dart Den other than the Lounge or Soapbox forums. This includes but is not limited to words and/or insinuations in avatars, posts, and/or signatures.
Users agree to not post nudity or pornography in any form in the forums. This includes but is not limited to avatars, words and/or insinuations in avatars, posts, and/or signatures.
9. Intellectual Property Infringement.
DD strictly forbids each member from posting, requesting or offering for sale any item, product, material, or service that infringes or potentially infringes upon another's copyright, trademark, or patent, including but not limited to articles, writings, images, and artwork.
Due to the large amount of traffic DD encounters, checking the sources of each posted text, image, and item for sale is virtually impossible. If you are aware of any infringing work or conduct that is posted on any section of DD, including but not limited to the forums or galleries, please immediately report this to DD's Owner(s).
10. User Privacy
Dart Den collects information during the registration process to operate the site ("Registration Information"). It collects non-personally identifiable information only (often referred to as demographic information) such as: country, region or city, zip or postal code, gender, and birth year. You may update your Registration Information any time by clicking the "Settings" link found on the horizontal black bar on the upper part of any Dart Den page.
Your Registration Information is used only for demographic statistics. Dart Den does not share any of your personal with any third parties. Dart Den will not disclose your Personal Information unless acting under a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of Dart Den; (3) enforce the User Agreement; or (4) act to protect the interests of its members or others.
A special registration form during contests/promos may be used for the purpose of gathering demographic information from the contest/promo participants. This information can be shared with the contest/promo sponsors depending on Dart Den agreement with them.
Dart Den may also send periodic member letters to announce important service changes, new features, and technical issue updates.
11. Parental Supervision / Children's Guidelines
At the time of registration, it is required that users honestly report whether they are under 13, or 13 and older at time of registration. Dart Den will not be held responsible for users who answer this question untruthfully. Dart Den encourages parents to monitor their children who are under 13 years of age. Children under 13 years of age are required to provide information of consent from a parent or guardian under the rules of US federal law encompassed by the US Children's Online Privacy Protection Act of 1998 (COPPA).
Be advised, some topics, discussions, pictures, imagery or verbiage seen or found on Dart Den may not be suitable for children.
12. Limitation of Use
Dart Den reserves the right to limit, restrict or deny the use of Dart Den forums to any individual or group at any time and / or for any reason.
3. Dispute Resolution
DD reserves the right to modify, amend, and change this User Agreement Contract in any fashion at any time, without notice.
Should disputes arise, the most current version of DD's User Agreement Contract applies, at the time DD's owner(s) become formally notified of the dispute by the member / account user.
The Owner, Administrators, Moderators or Members of Dart Den is under no obligation to engage in any member dispute at any time. All dispute resolution will begin or terminate on a case by case basis decided by the Owner of Dart Den solely, and will be handled via PM or e-mail.
Members do not have a right to any telephone conversation with an Owner, Moderator or other Member at any time.
14. No Warranty
Dart Den disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of any or all information or material in the Dart Den forums.
Dart Den disclaims any responsibility for the deletion, failure to store, miss-delivery, or untimely delivery of Messages.
Dart Den disclaims any responsibility for any harm resulting from downloading or accessing any information or material through Dart Den.
The Dart Den web site and services are provided "as is," and Dart Den and its co-brand partners expressly disclaim all warranties or conditions of any kind (whether express, implied or statutory), including without limitation the implied warranties of title, non-infringement, and fitness for a particular purpose. Without limiting the foregoing, Dart Den does not promise or warrant to you that any aspect of the web site and system will work properly or will be available continuously.
15. No Liability
In no event shall Dart Den be liable to any party for any loss or damage, including but not limited to lost revenues or profits or special, indirect, incidental or consequential damages (howsoever arising, including negligence) arising out of or in connection with the Dart Den website, its services, use, or this User Agreement Contract.
16. Access Limits
Without the prior written consent of Dart Den, you may not (a) use any automated means to access the site or collect any information from the Dart Den website (including without limitation robots, spiders or scripts), or (b) frame the site, place pop-up windows over its pages, or otherwise affect the display of its pages.
17. Services, Fees and Charges
Dart Den reserves the right to modify the services offered by Dart Den from time to time, with or without notice, including the right to terminate such services. Dart Den reserves the right to charge any fees for use or participation in the Dart Den forums. At present, however, Dart Den does not charge any fees for participation in the Dart Den.
18. Amendments
Dart Den reserves the right to amend any of the terms and conditions of this Agreement at any time and for any reason. Such amended terms and conditions shall be effective when posted on the Dart Den Forum / Website.
19. Suspension, Banning or Termination of Account
Dart Den reserves the right to Suspend, Ban or Terminate your use of Dart Den at anytime, with or without notice. Following termination, at its sole option, Dart Den may remove some or all of your Messages, Photographs, Images or text from the Dart Den website or leave it available for public view, without need of notice or approval from any member. Banning and/or termination of account, whether valid or invalid, will be effective immediately -disabling the member's account for the specified time or permanently deleting the account.
The banned / terminated member will no longer have access to the privileges of members in good status and will not have access to or any right to access of any stored information on DD's server, including any information placed by or sent to the member in question.
The banned / terminated member does not have a right to have their information stored, maintained, deleted, or modified in any fashion during or after the application of this penalty.
DD may implement any type or series of penalties for any member's deviation of this User Agreement Contract. Each infraction will be determined on a case by case basis by the administrators/owners and Moderators. These actions may include written warnings, temporary account bans, removed access to the private messaging system, and in certain situations account termination.
Application of the preceding penalties will not always be implemented in steps. A member's first Infraction may lead to immediate account termination. The application of these penalties is the sole decision of DD's Owner(s) and cannot be challenged or appealed.
Members / Users have no specific rights to any particular form or method of notification of an infraction, suspension, banning or termination of an account.
20. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the United States of America. In the event of any dispute arising out of or in connection with this Agreement, the venue shall be the proper courts of United States of America.
21. Conclusion
DD is a volunteer based initiative, dedicated to building a friendly community and an academic resource for dart frog enthusiasts. The actionable conduct described within this User Agreement is merely illustrative and any conduct that prevents DD from continuing with this mission may be cause for banning or termination of account. If you have a question whether posts, actions, or other conduct is acceptable on this site, please contact DD administrators and we will happily assist and direct you.
By completing the registration form, logging in, and continuing use of Dart Den.com, I certify that I understand and agree to the above terms, meet each of its requirements, am over the age of 17, and will comply with these terms throughout my membership. If you have any questions about these terms or concerns that you cannot conform to their requirements, please refrain from registration and immediately contact DD's owners at Administrator@Dartden.com

All messages, postings, images, text or chat, express the views of the author alone, and neither the Owners, Administrator nor Moderators of Dart Den, shall be held responsible for the content of any message.
Please read the following Term and Conditions carefully. By participating in our Website / Forum as a member, you will be deemed to have agreed to be bound by said Terms and Conditions of this entire User Agreement and Contract, and to faithfully comply with same at all times.

1. Registration Requirements
All information required upon registration for each member / user on Dart Den must be accurate and complete. You must update and verify all such information as needed in order to ensure that the information continues to remain accurate and complete.
To become a member of Dart Den, each prospective member must request an account through the forum's registration system, accessed at REGISTER. DD will process the submitter's membership application and, proving that the information is complete and all requirements for registration are satisfied, will forward an invitation to activate the account requested. This invitation may be revoked at any time for any reason listed below, above, or for any reason, whether stated or unstated, by DD's Owner(s).
Submission of the registration form represents the prospective members agreement to the terms of this User Agreement Contract and any subsequent changes, at the point those changes are made and notice is posted within the Community Message forum, available at Community Messages
The individual must be a person, above the age of 17 with the capacity to consent to this User Agreement.
1. Individuals between 14 and 17 years of age may be members of DD under the following conditions. As per the TITLE XVII of the CHILDREN'S INTERNET PROTECTION Act, if the individual is under the age of 18, the parents/guardians of the individual must contact DD's owner before registration. DD will complete the necessary documentation and then complete the registration for this minor individual.
2. Concealing ones age to avoid the above requirement is prohibited.
The individual does not already have an existing account with DD and/or has not received an invitation to activate any account in the past by DD.
The individual has not received a Termination of Account Notice or has had an account terminated in the past for any reason.
The individual has not received a Temporary Ban Notice or has had an account temporarily banned in the past for any reason.
2. Use of Member ID and Password
While you are using Dart Den, it is assumed that all activities made using your Member ID and password are authorized by you - the registrant and owner of that account.
3. Posting of Messages, Photographs and Images
Each DD member acknowledges that all posts made to these forums express the views and opinions of the author and not the Owner(s), Administrators, Moderators or Webmaster (except for posts by these people) and hence will not be held liable for any resulting harm.
DD requires each member to maintain a respectful, fair, friendly, and civil approach to every discussion, posting, chat, image, advertisement, etc.
Each DD member is strictly forbidden from posting, writing, displaying, discussing or causing to be posted, written, displayed, or discussed any abusive, obscene, vulgar, hateful, libelous, threatening, or sexually-oriented material or further, any other material that may violate any applicable law.
Members having concerns about users, persons and/or businesses should contact a board moderator or site administrator with an explanation of the situation.
Each registrant is allowed only one active DD account. No duplicate accounts or posting under different screen-names is permitted.
Posting for another member or non-member, or posing as, or using someone else's account to post is prohibited.
DD will not allow excessive use of its system, including excessive posting, placement of large files on DD.s servers or any other server utilized by DD, including excessive messaging, spamming, flooding, denial of service attacks, etc.
All information placed at any time on DD's servers or any other server utilized by DD is property of DD, and may be utilized, searched, viewed, edited, modified, displayed, deleted, etc. in any fashion.
Members may only access information intentionally provided by DD and may not use cracks, coding flaws, or other tools to mine or gain unauthorized access to protected information.
DD will not release, sell, or trade any information submitted through the registration system, except selected usernames, to any third party, unless required to do so by law or for transfer to a person or organization during a full or partial acquisition.
The IP address and further computer identification, routing, locality, and service provider information of each member is recorded and stored to aid in enforcing this User Agreement Contract.
Each member must agree to DD's use of cookies to store information on their computer.
The topic and text of any post should conform and be on-Topic and relevant to the description of the respective forum where it is posted. Moderators will, may, and can move, edit, delete, or otherwise modify irrelevant posts. Excessive posting of irrelevant posts will lead to referral to the below penalties.
Members should not hijack or change the topic of a parent post. Excessive hijacking of posts will lead to referral to the below penalties.
Forums, topics, posts, images, and any other data may be modified in any fashion by DD moderators, administrators, and owner(s).
Avatars larger than 80px x 80px are not permitted anyone using an avatar larger will be asked to remove or modify it. No Avatar will have Flash or moving imagery.
Signatures - pictures, animated gifs, enlarged text, advertisements, and for sale, trade or wanted item advertisements are not permitted to be included in any signature line(s).
Members are free to post a gallery of images in the DD Gallery, so long as those pictures do not violate any other portion of this User Agreement Contract and the member's gallery's size does not exceed the allocated disk space.
Pictures posted to the gallery should be germane to the mission of this forum – Dart Frogs and related topics. Pictures may be removed at the discretion of the site administration for any reason, at any time.
4. User Conduct
You agree not to provide any Messages, Avatars, Titles, Signatures to the Dart Den forums that:
(a) infringes any third-party intellectual property or publicity/privacy rights, (b) is knowingly false, and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, threatening, invasive of a person's privacy, or otherwise violation of any law or regulation, (c) contains any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, and (d) promotes piracy.
As each forum is specifically tailored to address certain topics, you are responsible for initiating new threads in the correct forum. You should stay on-topic at all times. The appropriate content for each forum is described in detail on the Dart Den forums homepage.
You agree not to post the same message in multiple forums without permission from the Dart Den Administrator. All such requests for permission should be directed through the Administrative forum.
"Impersonation," or assuming the character of another member by copying his username and manner of writing, is not allowed.
"Multiple User Names," or assuming the character of more than one member by using more than one username and manner of writing, is not allowed.
"Flaming or lashing out at other participants or displaying repeated dissatisfaction of Dart Den Administration and corrective actions, is not allowed.
"Spamming," or sending unsolicited electronic junk mail or junk newsgroup postings, in any form, is not allowed.
"Trolling," or posting insulting or deliberately divisive threads/replies for the purpose of (1) harvesting retaliatory insults and flames, or (2) throwing off the balance of the forum, is not allowed.
You agree not to disrupt the normal flow of dialogue or "flood," cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges.
You agree not to use the Dart Den forums to either advertise or promote commercial endeavors, which includes direct posts, as well as, active links to other sites on the Internet, without permission from the Dart Den Administrator. All such requests for permission should be directed through the Administrative forum. You may, however, include URLs or active links to commercial sites, reasonable in number, only for the sole purpose of expanding on comments or providing additional information as part of regular forum interactions.
You agree that you will not incorporate any word in your name, Message ID or custom user title or Avatar, that is defamatory, obscene or profane, or which violates any trademark, service mark, or other proprietary/intellectual property rights of any third party, including, without limitation, that of Dart Den.
Harassment of DD administrators, moderators, owner(s), or other members is strictly forbidden. In those cases where members have questions about moderation of a particular topic, they should take up their concerns privately with the appropriate moderator and/or Dart Den administrator/owner. Public posts questioning said action(s) are restricted.
5. Chat use
The DD chat room will not be Moderated or supervised. As always, each member's use of the chat room acknowledges that statements presented in the DD chat room forums express the views and opinions of the author and not the owner(s), administrators, moderators or webmaster and hence will not be held liable for any resulting harm.
6. Classified Advertisements, Vendors, Sellers and Trading
Each DD member must acknowledge that all items placed within the Classifieds and Trading Post forums are not attributable to DD, its moderators, administrators, or owners. DD does not offer any warrantee or guarantee on listed items. Anyone utilizing the DD servers to sell, offer, accept, trade, or purchase any item or service agrees to hold DD, its moderators, administrators, and owners harmless should any harm result from any transaction. DD is not involved in the actual transaction between buyers and sellers. As a result, DD has no control over the quality, safety or legality of the items advertised the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. DD cannot ensure that a buyer or seller will actually complete a transaction.
Classified items should be placed in the related section. We do not permit ads for Venomous or HOT animals.
DD may remove any item from the Classifieds and/or Trading Post forums at any time for any reason.
Classifieds posted as standalone threads or posted in an unrelated thread in this section will be removed.
Replies to ads are only allowed for questions and answers concerning the products in the ad, and requests for additional information. All other comments will be removed
Sponsor Agreement Guidelines
All sponsor, employees, agents, and contractors of said sponsor must comply with the User Agreement Contract as members of the forum. All sponsors, employees, agents, and contractors of said sponsor must comply with any federal and state law regarding the advertisement, sale, and distribution of animals, plants, products, and all other relevant subjects. Parties in violation of the User Agreement Contract will have their banners and associated user accounts immediately removed from Dart Den. Sponsors will not represent themselves as representatives, contractors, or agents of Dart Den. Sponsors agree to indemnify Dart Den.com for costs in any legal action relating to advertisement disputes. Sponsors agree to indemnify Dart Den.com for costs and damages in any third party legal action. Sponsors may remove their banner from Dart Den by request, but therein forfeit any prorated refund. By submitting payment, the sponsor represents that he or she has been authorized to execute this agreement on behalf of the named sponsor. The sponsor agrees to the terms of this User Agreement Contract. 1000f the sponsorship fees are due and payable by PayPal or Credit Card with receipt of the signed contract and must be paid in full prior to listing of a banner. All fees paid are non-refundable.
*Note- Dart Den.com reserves the right to refuse sponsorship to any party if Dart Den deems there is a conflict of interest based on this sites content or for any other reason.
7. Seller –Buyer – Trader Feedback and Transaction Ratings
All transaction feedback, Ratings and related conversations are only permitted in the "Seller – Buyer -Trader Feedback and Transaction Ratings" forum (also referred to as the "Feedback Forum", for short), which requires Dart Den site user membership and agreement to all site rules and regulations. Seller–Buyer–Trader Feedback and Ratings is not permitted in threads, posts, ads, signatures or anywhere else.
Here are Examples of what are considered permitted postings that can be used in any other sections of Dart Den, at any time:
o "Here is a picture of my new pumilio, thanks to _______."
o "Please contact me via PM or email with your experiences with ______."
o "Where did you get that cool Bromeliad?"
The Feedback system is currently operating on a trial basis and may be removed at any time for any reason.
As a DD member, you agree to always use caution, fairness and good judgment when leaving Feedback for another Member, Vendor or Sponsor.
Dart Den's Feedback forum is designed to encourage open and honest trading. However, to insure that Feedback is used for the proper purpose and not abused, DD has some basic rules that must be followed.
Members agree to never attempt to undermine the Feedback system by using practices such as:
Feedback Extortion - Threatening to leave negative or neutral feedback for another member unless the other member provides goods or services not included in the original listing
Feedback Manipulation - Feedback left or received where the Feedback's primary value is to artificially enhance a member's reputation
Feedback in Seller Terms and Conditions - Sellers are not permitted to include in their listings or terms of sale any conditions that limit or restrict the buyer from leaving Feedback.
Feedback Abuse – Buyers or Sellers are not permitted to include links, profanity or other inappropriate or unrelated content within Feedback comments.
Feedback comments containing any of the following are not permitted:
*Links or scripts
*Negative statements left for a buyer that conflict with the positive rating
*Personally identifying information about another member, including but not limited to, real names, address, phone number, or email address
*Political, religious, or social commentary rather than a genuine comment about the transaction
*The comment, reply, or follow-up references a completely separate transaction or unrelated experience
*Profane, vulgar, obscene, racist language or any verbiage that would violate any laws.
*Inflammatory language, such as fraud, liar, cheater, scam artist, con man.
Any Violation of Dart Den policies may result in an infraction being issued, account suspension or account termination, at any time.
8. Content Filtering
Dart Den reserves the right to edit, delete, or prune any and all Messages which, in its sole opinion, violates any of the terms and conditions of this Agreement, or is viewed in our judgment as inappropriate at the time of submittal or for any other reason, at anytime thereafter.
Dart Den may elect, at its sole discretion, to monitor some, all, or no areas of Dart Den for adherence to these terms and conditions or Dart Den policies and guidelines.
Dart Den does not endorse or recommend any of the opinions or ideas contributed by its users.
Dart Den is not responsible for any Messages, Text or Imagery expressed anywhere in Dart Den.com forums. Dart Den does not attempt to control or validate any comments or a recommendation provided by the participants and is not responsible for any inaccuracies in the Messages. Therefore, you alone bear the risk associated with the accuracy, completeness or usefulness of any Messages, imagery posted or sent to others.
Information contained in the Dart Den forums, including but not limited to those relating to law or medicine or other fields, is not intended to substitute for the advice or opinion of your own lawyer or physician or professional adviser. You agree not to rely solely on any of the advice or opinion expressed anywhere in Dart Den. Under no circumstances, including but not limited to negligence, shall Dart Den be liable for any reliance on any such information, nor shall Dart Den be liable for any direct, incidental, special, consequential, indirect or punitive damages that result from the use of, or inability to use, the information in Dart Den.
Dart Den specifically does not endorse or recommend any posts which encourage breeding Hybrid morph Dart Frogs, Selectively breeding Dart Frogs, Mixed or unknown locale Dart Frogs, Invasive species (plant or animal) and prohibits the use or said use of any illegal activates.
Users agree not to post anything which incorporates politics or religion in any form, anywhere on Dart Den other than the Lounge or Soapbox forums. This includes but is not limited to words and/or insinuations in avatars, posts, and/or signatures.
Users agree to not post nudity or pornography in any form in the forums. This includes but is not limited to avatars, words and/or insinuations in avatars, posts, and/or signatures.
9. Intellectual Property Infringement.
DD strictly forbids each member from posting, requesting or offering for sale any item, product, material, or service that infringes or potentially infringes upon another's copyright, trademark, or patent, including but not limited to articles, writings, images, and artwork.
Due to the large amount of traffic DD encounters, checking the sources of each posted text, image, and item for sale is virtually impossible. If you are aware of any infringing work or conduct that is posted on any section of DD, including but not limited to the forums or galleries, please immediately report this to DD's Owner(s).
10. User Privacy
Dart Den collects information during the registration process to operate the site ("Registration Information"). It collects non-personally identifiable information only (often referred to as demographic information) such as: country, region or city, zip or postal code, gender, and birth year. You may update your Registration Information any time by clicking the "Settings" link found on the horizontal black bar on the upper part of any Dart Den page.
Your Registration Information is used only for demographic statistics. Dart Den does not share any of your personal with any third parties. Dart Den will not disclose your Personal Information unless acting under a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of Dart Den; (3) enforce the User Agreement; or (4) act to protect the interests of its members or others.
A special registration form during contests/promos may be used for the purpose of gathering demographic information from the contest/promo participants. This information can be shared with the contest/promo sponsors depending on Dart Den agreement with them.
Dart Den may also send periodic member letters to announce important service changes, new features, and technical issue updates.
11. Parental Supervision / Children's Guidelines
At the time of registration, it is required that users honestly report whether they are under 13, or 13 and older at time of registration. Dart Den will not be held responsible for users who answer this question untruthfully. Dart Den encourages parents to monitor their children who are under 13 years of age. Children under 13 years of age are required to provide information of consent from a parent or guardian under the rules of US federal law encompassed by the US Children's Online Privacy Protection Act of 1998 (COPPA).
Be advised, some topics, discussions, pictures, imagery or verbiage seen or found on Dart Den may not be suitable for children.
12. Limitation of Use
Dart Den reserves the right to limit, restrict or deny the use of Dart Den forums to any individual or group at any time and / or for any reason.
3. Dispute Resolution
DD reserves the right to modify, amend, and change this User Agreement Contract in any fashion at any time, without notice.
Should disputes arise, the most current version of DD's User Agreement Contract applies, at the time DD's owner(s) become formally notified of the dispute by the member / account user.
The Owner, Administrators, Moderators or Members of Dart Den is under no obligation to engage in any member dispute at any time. All dispute resolution will begin or terminate on a case by case basis decided by the Owner of Dart Den solely, and will be handled via PM or e-mail.
Members do not have a right to any telephone conversation with an Owner, Moderator or other Member at any time.
14. No Warranty
Dart Den disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of any or all information or material in the Dart Den forums.
Dart Den disclaims any responsibility for the deletion, failure to store, miss-delivery, or untimely delivery of Messages.
Dart Den disclaims any responsibility for any harm resulting from downloading or accessing any information or material through Dart Den.
The Dart Den web site and services are provided "as is," and Dart Den and its co-brand partners expressly disclaim all warranties or conditions of any kind (whether express, implied or statutory), including without limitation the implied warranties of title, non-infringement, and fitness for a particular purpose. Without limiting the foregoing, Dart Den does not promise or warrant to you that any aspect of the web site and system will work properly or will be available continuously.
15. No Liability
In no event shall Dart Den be liable to any party for any loss or damage, including but not limited to lost revenues or profits or special, indirect, incidental or consequential damages (howsoever arising, including negligence) arising out of or in connection with the Dart Den website, its services, use, or this User Agreement Contract.
16. Access Limits
Without the prior written consent of Dart Den, you may not (a) use any automated means to access the site or collect any information from the Dart Den website (including without limitation robots, spiders or scripts), or (b) frame the site, place pop-up windows over its pages, or otherwise affect the display of its pages.
17. Services, Fees and Charges
Dart Den reserves the right to modify the services offered by Dart Den from time to time, with or without notice, including the right to terminate such services. Dart Den reserves the right to charge any fees for use or participation in the Dart Den forums. At present, however, Dart Den does not charge any fees for participation in the Dart Den.
18. Amendments
Dart Den reserves the right to amend any of the terms and conditions of this Agreement at any time and for any reason. Such amended terms and conditions shall be effective when posted on the Dart Den Forum / Website.
19. Suspension, Banning or Termination of Account
Dart Den reserves the right to Suspend, Ban or Terminate your use of Dart Den at anytime, with or without notice. Following termination, at its sole option, Dart Den may remove some or all of your Messages, Photographs, Images or text from the Dart Den website or leave it available for public view, without need of notice or approval from any member. Banning and/or termination of account, whether valid or invalid, will be effective immediately -disabling the member's account for the specified time or permanently deleting the account.
The banned / terminated member will no longer have access to the privileges of members in good status and will not have access to or any right to access of any stored information on DD's server, including any information placed by or sent to the member in question.
The banned / terminated member does not have a right to have their information stored, maintained, deleted, or modified in any fashion during or after the application of this penalty.
DD may implement any type or series of penalties for any member's deviation of this User Agreement Contract. Each infraction will be determined on a case by case basis by the administrators/owners and Moderators. These actions may include written warnings, temporary account bans, removed access to the private messaging system, and in certain situations account termination.
Application of the preceding penalties will not always be implemented in steps. A member's first Infraction may lead to immediate account termination. The application of these penalties is the sole decision of DD's Owner(s) and cannot be challenged or appealed.
Members / Users have no specific rights to any particular form or method of notification of an infraction, suspension, banning or termination of an account.
20. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the United States of America. In the event of any dispute arising out of or in connection with this Agreement, the venue shall be the proper courts of United States of America.
21. Conclusion
DD is a volunteer based initiative, dedicated to building a friendly community and an academic resource for dart frog enthusiasts. The actionable conduct described within this User Agreement is merely illustrative and any conduct that prevents DD from continuing with this mission may be cause for banning or termination of account. If you have a question whether posts, actions, or other conduct is acceptable on this site, please contact DD administrators and we will happily assist and direct you.
By completing the registration form, logging in, and continuing use of Dart Den.com, I certify that I understand and agree to the above terms, meet each of its requirements, am over the age of 17, and will comply with these terms throughout my membership. If you have any questions about these terms or concerns that you cannot conform to their requirements, please refrain from registration and immediately contact DD's owners at Administrator@Dartden.com
